Acceptance of the use of Walton Flooring Centre Terms and Conditions

Your access to and use of Walton Flooring Centre is subject exclusively to these Terms and Conditions. You will not use the website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the website.

Credit card details
Walton Flooring Centre will never ask for your credit card details and we advise our customers to not enter their credit cards details on Walton Flooring Centre’s website or by submitting such details in any other form.

Interpretation
In these conditions and the invoice overleaf, Customer means the person or persons purchasing the goods as detailed on the invoice overleaf. The Goods means the goods described on the invoice. Contact means the contract for the sale by the company to the customer of the goods constituted by these terms and including the invoice. The company means Walton Flooring Centre the installer means the self-employed installation team. The headings are for convenience and do not affect interpretation.

Legal title
The legal title to the goods shall remain in the property of the company until any monies whatsoever which are owing to the company by the customer have been paid. The company reserves the rights for its agents, servants or employees to enter the premises of the customer and repossess the goods, in the event of non-payment of the outstanding balance.

Basis of the sale
The goods are sold by the company on the terms contained in the sales of goods act 1979 except as expressly varied by the invoice and/or by these terms. No change may be made to the contract unless agreed in writing by the company.

Orders and specifications
The company may make any changes in the specification of the goods which are required to conform with relevant safety for other statutory requirements or which do not materially affect their quality or performance.

Cancellations
If any contract is cancelled by the customer prior to delivery, the customer will be liable to pay the company 20% (special order contracts 30%) of the price of the goods to cover expenses incurred and this will be deducted from any deposit or advance payment paid by the customer. The contract cannot be cancelled by the customer after delivery. The company may cancel the contract at any time before it notifies the customer that the goods are ready for delivery/collection if it is unable to fulfil the invoice due to any cause beyond its control. In the event the company’s only liability is to refund any deposit or advance paid by the customer.

Your independent installer
When you place your order in store with us, we will refer you to an installer who can deliver and fit the product at your delivery address.

All installers carry out the delivery and fitting service at a standard tariff, unless the installer is required to move any of your furniture (which is not of reasonable size, weight and/or quantity) in order to install the product. Your sales representative will inform you of the standard tariff at the time of placing your order.

Should you wish to use an installer referred by us, one of our sales representatives will book an appointment for you. We will give your name, address and telephone number to the installer so that he/she can fit the product or contact you if there is a problem.

Your installer will attend all appointments made by us on your behalf, except if there is unforeseen delay, in which case we or the installer will contact you to discuss any necessary alterations to the appointment as soon as we or he reasonably can. If you need to change a pre-arranged appointment you must contact the store where you ordered your Product directly to arrange an alternative appointment.

Before installing the product, the installer will ensure that it is the product that has been ordered by you, that it is in good condition and is the correct size. In the event that the product does not meet these requirements, the installer will not fit the product and will return it to our Distribution Centre, and we will order a replacement. If the installer fails to check the product in accordance with this condition and the product does not meet these requirements, he/she will re-fit any replacement product without charge to you.

The installer may ask you to confirm and sign documentation to state that the product has been delivered to you satisfactorily.

Installers introduced to you by us provide an independent delivery and fitting service. We do not employ the installers that we refer to you; we act as introducers only and if you wish to use one of the installers referred by us, you will have a separate agreement between you and the installer.

We do not warrant nor take responsibility for, the standard or quality of, and any liability arising from, the services provided by the installer including (without limit) the delivery and/or fitting of the product by the installer. If you have a complaint relating to the installer and the services provided you must contact the installer directly. We accept no responsibility or liability in this regard. However, we require the installer to guarantee his workmanship to you for two years.

If you decide not to use one of our installers and you decide to use your own third-party fitting service, then there are 2 (two) options for delivery. First, we may agree to deliver the Product to you. Secondly, you may use your own delivery service in which case you or your chosen third-party delivery service must collect the Product from our distribution Centre, as agreed by us in advance. Please note that you must use the first delivery option if you have chosen one of our interest free payment options; i.e. we must deliver the Product to you – you may not use your own delivery service.

If you, or your chosen third-party delivery service, collect the Product pursuant to condition above, we will require personal identification and/or satisfactory evidence that the third party is collecting the Product on your behalf (photographic ID such as a passport or driving license plus proof of address) before we will agree to release the Product to you or toe third party appointed by you. We will also need any third-party delivery service to supply us with a proof of delivery.

Terms of Payment
Full payment for goods detailed on the invoice is due 48 hours before installation. Walton Flooring Centre will introduce the services of the installers and that is for you to pay them direct, unless the customer chooses to pay Walton Flooring Centre for the services for then Walton Flooring Centre to pay the installers on behalf of the customer.

General
Although the company will always endeavour to meet all delivery or collection agreements, no liability will be accepted by the company for a claim of compensation should the agreed date be extended from the original agreement made.

No liability is accepted by the company in respect of the goods supplied by the company in accordance with the customers own specification/measurements. Nothing contained within the Terms and Conditions of sales, will affect your statutory rights.

All cut pile carpets, whatever their quality, method of construction or pile content, may show a shading effect when in use (and in some cases even without wear) though when and where it will occur cannot be predicted. Variously referred to as water marking, pooling, tracking or pile pressure. Shading is characteristic of all textile materials with a pile or nap, but the effect is especially noticeable on plain velvet carpets with a high proportion of open ground in the pattern. Areas of shading are irregular in shape and size and have a darker appearance than the surrounding carpets when seen from one angle of the pile, which may be permanent. The shading effect, which may be accentuated by room lighting or certain areas of frequent use, does not affect the quality of wear/ life of the carpet and is not a fault in manufacture.

When carpets are selected from samples it is occasionally found that variations occur in colour to the actual carpet supplied. Every effort will, of course, be made to ensure as exact a match as possible, but no guarantee of matching can be given.

The sizes as quoted for the width of the carpet are approximate. This can vary due to several factors and the tolerance conforms with British Standards institute No. 3655 allowing for a variation of + 1.25%.

In the case of partial completion of an order, which may occur for a variety of reasons, the company shall be entitled to payment proportional to the amount of goods supplied and work carried out.

Cleaning
Walton Flooring Centre recommend that carpets should be cleaned by professionals. A dry-cleaning method should be used when cleaning woven carpets such as Wiltons and Axministers as any other method of cleaning may result in the carpet shrinking or distorting.  Improper cleaning can cause water damage to Laminate flooring. Avoid heavy mopping when cleaning the floor and dry it immediately. Sponge up spills immediately. Do not allow any liquid to sit on the floor for long periods of time. Check appliances and plumbing regularly for leaks.

Furniture & uplift of existing carpet/flooring
The installers that are introduced to the Customers of Walton Flooring Centre are only installers of the products detailed on the invoice. Walton Flooring Centre do not offer uplift or move furniture as a service. The independent installers may offer this as a chargeable service if 48 hours notice has been given to them. If the independent installers arrive and have not been informed of the moving furniture or uplift of existing carpet/flooring, they may not be able to start the customers job and will charge a call out fee before rebooking the installation. If they do have the time, they will charge accordingly for their services.

Interest Free Credit
Walton Flooring Centre can also offer interest free options on all purchases £500 or over for 12 months. It’s quick and easy and you’ll have a decision in minutes!
You can choose to spread your payments across either 12 month’s interest free instalments or our longer term low rate 5 year finance 9.90% APR. This does not include the cost of fitting your flooring as this work is carried out by 3rd parties.
